Parties & Scope of Agreement
These Terms of Service constitute a binding agreement between you ("Client," "you," or "your") and APCON LLC, a Washington State limited liability company operating under the trade name Realty Repair Co. ("APCON LLC," "we," "us," or "our").
These terms apply to: (a) your use of the website at apconllc.com and realtyrepairco.com; (b) your submission of any service request, contact form, or diagnostic inquiry; and (c) any repair or remediation services performed under a written project contract. In the event of a conflict between these Terms and a signed project contract, the project contract controls.
APCON LLC holds Washington State General Contractor License APCONL*825QO, general liability insurance, and a surety bond as required by RCW 18.27. All work is performed in compliance with applicable Washington State law.
Services Offered
APCON LLC provides the following services through the Realty Repair Co. trade name:
- Forensic structural diagnostics ($350 flat fee, credited in full toward the repair project)
- Structural beam, post, mudsill, and framing repair
- Crawl space repair and floor joist reconstruction
- Dry rot remediation and wood replacement
- Water damage reconstruction
- Pre-listing inspection repair scopes
Specialty Trade Coordination
APCON LLC holds a general contractor license and does not self-perform electrical, plumbing, or HVAC work. Where specialty trade work is required as part of a project scope, APCON LLC coordinates licensed and insured specialty subcontractors under its GC oversight authority per RCW 18.27. All subcontractors are independently licensed and carry their own general liability insurance.
Services Not Offered
APCON LLC does not provide painting, pressure washing, landscaping, cleaning, or general property maintenance. Inquiries for those services will be referred out. APCON LLC does not provide emergency response services, hourly billing arrangements, or verbal estimates in lieu of written contracts.
Forensic Diagnostic & Entry Point
All new client engagements begin with a $350 forensic diagnostic. This fee covers an on-site structural assessment, moisture evaluation, identification of all defect conditions, and delivery of a written diagnostic summary.
The $350 diagnostic fee is credited in full toward the repair contract if the Client proceeds with APCON LLC for the remediation work. The credit applies only to the project directly resulting from the diagnostic and expires 90 days from the date of the diagnostic report.
The diagnostic fee is non-refundable once the on-site assessment has been performed, regardless of whether the Client proceeds with repair. The fee covers the cost of the inspection, travel, and written reporting, not just the outcome.
No free estimates. APCON LLC does not provide verbal quotes, ballpark estimates, or "drive-by" assessments. The $350 diagnostic is the sole entry point for all repair engagements and is required before any scope of work or contract can be issued.
Project Contracts & Scope of Work
All repair and remediation work is performed under a written, lump-sum fixed-price contract. APCON LLC does not offer time-and-materials, cost-plus, or hourly billing arrangements for repair work.
The project contract will define: the full scope of work; the fixed contract price; the payment schedule; the project timeline; any exclusions or conditions; and the terms of the five-year written structural guarantee. No work begins until both parties have executed the written contract and the deposit has been received.
Scope Changes
If latent conditions are discovered during repair that are outside the written scope — such as concealed rot, structural damage not visible at the time of diagnostic, or code-required upgrades — APCON LLC will stop work, document the condition, and present the Client with a written change order prior to proceeding. No change order work is performed without written Client approval. Change orders are priced on a lump-sum fixed basis and added to the original contract.
Client Responsibilities
Client is responsible for providing unobstructed access to the work area on scheduled dates, disclosing any known hazardous materials (asbestos, lead paint, etc.) present at the property, and ensuring the property is legally accessible for the duration of the project. Failure to provide access on scheduled dates may result in rescheduling fees or contract cancellation per Section 7.
Five-Year Structural Guarantee
APCON LLC provides a five-year written structural guarantee on all completed repair work. The guarantee covers defects in materials and workmanship for the structural scope performed under the signed project contract.
What the Guarantee Covers
- Structural failure of repaired framing members, posts, beams, and mudsills installed by APCON LLC
- Failure of crawl space floor joist repairs and sistering work performed under contract
- Dry rot recurrence in areas that were fully remediated and treated under the project scope
- Water intrusion recurring through penetrations that were sealed and waterproofed under the project scope
What the Guarantee Does Not Cover
- New moisture intrusion originating from areas outside the project scope, including roof leaks, plumbing failures, or grading issues not addressed under the contract
- Damage caused by Client, third-party contractors, or subsequent alterations to the repaired area
- Normal wear, settlement, or cosmetic changes to materials
- Work performed by subcontractors under their own separate warranties
- Pre-existing conditions documented in the diagnostic report and excluded from the project scope
Guarantee Claims
To initiate a guarantee claim, contact dispatch@realtyrepairco.com with a description of the condition and photographs. APCON LLC will schedule a site visit within 10 business days of receipt. Valid claims will be remediated at no cost to the Client within a commercially reasonable timeframe.

Accepted Payment Methods
APCON LLC accepts check, ACH bank transfer, and major credit cards. Credit card payments may be subject to a processing fee disclosed at the time of invoicing. Cash payments are not accepted.
Late Payments
Invoices are due within 5 business days of issuance unless otherwise specified in the project contract. Balances unpaid after 10 business days accrue interest at 1.5% per month (18% per annum). APCON LLC reserves the right to suspend work on any active project where payment is more than 10 business days past due, without liability for resulting delays.
Lien Rights
APCON LLC reserves all lien rights under RCW 60.04 (Washington State Mechanics' and Materialmen's Lien Act). Client will receive a pre-lien notice as required by law. Failure to pay amounts due under a project contract may result in the filing of a materialmen's lien against the subject property.
Cancellation & Rescheduling
Diagnostic Cancellation
Diagnostic appointments may be rescheduled without penalty with at least 48 hours notice. Cancellations with less than 48 hours notice forfeit the $350 diagnostic fee. No-shows forfeit the full fee.
Project Cancellation by Client
After a project contract is executed and the deposit is received, if the Client cancels the project before work begins, APCON LLC will retain the deposit to cover scheduling, material procurement, and mobilization costs. If cancellation occurs after work has commenced, Client is responsible for the full value of work completed to date plus a 15% cancellation fee on the remaining unperformed scope.
Project Cancellation by APCON LLC
APCON LLC reserves the right to cancel a project contract if: (a) the Client fails to provide timely access to the property; (b) payment obligations are not met; (c) discovered site conditions present an undisclosed health or safety hazard; or (d) the Client materially breaches these Terms or the project contract. In such cases, Client is responsible for payment of all work completed to date. APCON LLC will refund any unearned portion of the deposit within 30 days.
Force Majeure
Neither party is liable for delays caused by events beyond reasonable control, including severe weather, acts of God, supply chain disruptions, or government orders. APCON LLC will notify the Client promptly of any force majeure delay and reschedule work at the earliest practicable date.

You may access and use the site for the purpose of evaluating and engaging our services. You may not reproduce, distribute, or commercially exploit any site content without prior written consent.
Submission of a contact form or service request through this website does not create a contractor-client relationship or obligate APCON LLC to provide services. A binding engagement is established only upon execution of a written project contract or, for the diagnostic, payment of the $350 diagnostic fee.
APCON LLC makes reasonable efforts to keep information on this website accurate and current but makes no warranty regarding the completeness or accuracy of any information presented. Service pricing, availability, and scope are confirmed in writing at the time of project contracting.
Limitation of Liability
To the maximum extent permitted by Washington State law, APCON LLC's total liability to the Client for any claim arising from services performed under these Terms or any project contract — whether in contract, tort, or otherwise — is limited to the total amount paid by the Client to APCON LLC for the specific project giving rise to the claim.
APCON LLC is not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of revenue, diminution in property value, or costs of alternative accommodations, even if APCON LLC has been advised of the possibility of such damages.
Nothing in this section limits APCON LLC's liability for: (a) gross negligence or willful misconduct; (b) personal injury caused by APCON LLC's negligence; or (c) claims that cannot be limited under applicable law.
The Client is responsible for maintaining homeowner's or property insurance covering the subject property during the project. APCON LLC's general liability insurance does not substitute for Client's property insurance.
Dispute Resolution
Informal Resolution
Before initiating any formal proceeding, the parties agree to attempt in good faith to resolve any dispute through direct communication. Client should contact APCON LLC in writing at dispatch@realtyrepairco.com with a description of the dispute. APCON LLC will respond within 10 business days with a proposed resolution.

These Terms and any project contract are governed by the laws of the State of Washington, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the courts of Pierce County, Washington.

In any dispute arising from these Terms or a project contract, the prevailing party is entitled to recover reasonable attorney's fees and costs, as permitted under RCW 4.84.330.
Indemnification
Client agrees to indemnify, defend, and hold harmless APCON LLC, its members, employees, and subcontractors from any claims, damages, losses, or expenses — including attorney's fees — arising from: (a) Client's breach of these Terms or any project contract; (b) Client's negligence or willful misconduct; (c) undisclosed hazardous materials or site conditions; or (d) Client's interference with the work or instructions to perform work outside the agreed scope.
APCON LLC agrees to indemnify the Client against claims for bodily injury or property damage directly caused by APCON LLC's negligence in performing the contracted work, to the extent covered by APCON LLC's general liability insurance.

Certificates of insurance are available upon written request. All specialty subcontractors coordinated by APCON LLC under GC authority are independently licensed and insured. Client may request evidence of subcontractor insurance prior to commencement of any subcontracted scope.
Entire Agreement & Amendments
These Terms of Service, together with any executed project contract, constitute the entire agreement between the parties regarding the subject matter herein and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.
APCON LLC reserves the right to update these Terms at any time. Updated Terms are effective upon posting to apconllc.com/terms-of-service. Continued engagement with APCON LLC after the posting of updated Terms constitutes acceptance. The Terms governing any active project contract are those in effect at the time the contract was executed.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
